This disclosure text includes fundamental information regarding KVKK.

First of all, we would like to emphasize that, as it is indisputable that membership cannot be a prerequisite for shopping on electronic commerce platforms, there is no membership requirement to make purchases through our company’s website (www.zukutustore.com), and membership has not been offered as a condition of service. In cases where you do not have a membership, your personal data is not processed for purposes based on explicit consent as a legal basis.

Definitions

PERSONAL DATA

According to Law No. 6698 on the Protection of Personal Data, personal data is defined as any information relating to an identified or identifiable natural person.

SENSITIVE PERSONAL DATA

Sensitive personal data includes information about a person’s racial or ethnic origin; criminal convictions and security measures; political opinions; philosophical beliefs; religious, sectarian, or other beliefs; clothing and appearance; membership in associations, foundations, or trade unions; health; sexual life; and biometric and genetic data. Processing of Personal Data

According to the Law, the Data Controller is the person who determines the purpose and method of processing personal data.

In accordance with Law No. 6698 on the Protection of Personal Data, your personal data will be processed by ZUKUTU TAŞ SANATI SANAYİ TİCARET LİMİTED ŞİRKETİ (zukutustore.com) as the data controller within the scope explained below. PURPOSES OF PROCESSING YOUR PERSONAL DATA, POSSIBLE USES, AND LEGAL BASIS

• Law No. 5549 on the Prevention of Laundering Proceeds of Crime,
• Law No. 4358 on the Widespread Use of Tax Identification Numbers,

as well as secondary regulations issued by competent authorities based on these laws, and obligations arising from contracts to which our company is a party in relation to these regulations or its activities (such as identity verification, data retention, reporting, and notification). Furthermore, the collection and use of personal data is necessary to fulfill our obligations arising from:

• Law No. 6563 on the Regulation of Electronic Commerce (provisions on personal data protection),
• Law No. 6502 on Consumer Protection and the Distance Contracts Regulation,
• Law No. 5237, the Turkish Penal Code, 

which in certain cases impose criminal sanctions to ensure the protection of personal data.

The personal data we collect

The reasons for sharing your personal data with us include the submission of your membership application through our website (www.zukutustore.com), handling satisfaction or complaints, delivering the products you have ordered, fulfilling the contract you have entered into with us and monitoring its other processes (carrying out sales and after-sales support activities), and providing information to public authorities when legally required in matters related to public security.

Organizing all records and documents, whether electronic (internet/mobile, etc.) or paper-based, that serve as the basis for processing, in order to evaluate customer complaints and suggestions, verify the identity of individuals making purchases through the website/mobile applications, and record other necessary information.

To increase customer satisfaction, to understand our customers who shop via the website and/or mobile applications, to use this information in customer network analyses, to utilize it in various marketing and advertising activities, and to conduct surveys electronically and/or physically through contracted institutions within this scope.

To enhance the user experience of the products and services offered by Zukutu Store, to plan and execute activities necessary for customizing recommendations and promotions according to the preferences, usage habits, and needs of the relevant individuals, to ensure user satisfaction, to plan and execute the marketing process of products and services, to provide personalized content to maximize the benefit from the products and services offered by our company, and to carry out digital marketing, targeting, on-site remarketing, and advertising activities.
7. To carry out the necessary activities by the relevant business units for the execution of the commercial operations conducted by the Company and to manage the associated business processes, including: planning, auditing, and implementing information security processes; establishing and managing the information technology infrastructure; monitoring finance and accounting operations; overseeing legal affairs; and planning and/or executing activities related to effectiveness, efficiency, and/or suitability analyses of business operations.
8. To plan and execute sales, marketing, and optimization processes to improve user experience for the purpose of determining and implementing the Company’s commercial and business strategies.
9. To conduct evaluations, analyses, and optimization activities regarding advertisements presented to you, within the scope of planning and developing processes related to the Company’s business and strategic objectives, in order to improve user experience.
10. To plan and execute market research activities for the sales and marketing of the products and services offered by the Company, including conducting market research and surveys.
11. To compile a summary of your preferences from information collected through daily logs, empty GIF files, and/or third-party sources via the website and mobile application.
12. To exercise our rights arising from applicable legislation while fulfilling all our legal obligations. 

For the reasons listed above, your personal data is processed based on the legal ground of “explicit consent” in accordance with the Law on the Protection of Personal Data (Law No. 6698), including the conditions and purposes for processing personal data specified in Articles 5 and 6 of the Law.

Accordingly, personal data may be shared with our business partners, suppliers, shareholders, and, in short, all legally authorized public institutions and private individuals, in accordance with Articles 8 and 9 of Law No. 6698 on the Protection of Personal Data, within the framework of the conditions and purposes of personal data processing specified therein.

Any such transfer will be limited to the small number of specific purposes listed in this disclosure text and will be made in compliance with applicable legislation. For the same purposes and within these limits, your personal data may also be shared with our foreign affiliates, shareholders, and business partners abroad based on your explicit consent, in accordance with Article 9 of the Law.

METHODS OF COLLECTING PERSONAL DATA AND LEGAL BASIS

RIGHTS UNDER ARTICLE 11 OF THE LAW, SUBJECT TO THE EXCEPTIONS PROVIDED IN ARTICLE 28 ENTITLED “EXCEPTIONS” OF THE LAW ON THE PROTECTION OF PERSONAL DATA (KVKK)

Within the scope of Article 11 of Law No. 6698 on the Protection of Personal Data, the data subject has the right to apply to the Data Controller at any time and to:

1. Learn whether his/her personal data has been processed,
2. Request information if his/her personal data has been processed,
3. Learn the purpose of processing personal data and whether it is being used in accordance with this purpose,
4. Know the third parties to whom personal data has been transferred, domestically or abroad,
5. Request the correction of personal data if it has been processed incompletely or inaccurately,
6. Request the deletion or destruction of personal data,
7. Request that the third parties to whom personal data has been transferred be notified of the correction, deletion, or destruction of such personal data,
8. Object to any result that may arise against the person by means of exclusive analysis of processed data through automatic systems,
9. Request compensation for damages in case of harm due to unlawful processing of personal data.

Note: You may exercise the rights under this article as of the effective date of the Regulation,October 7, 2016. In order to fulfill your requests, any costs incurred by our Company may be charged to you in accordance with the fee schedule specified in Article 13 of the KVKK, titled “Application to the Data Controller.”
